In the current issue of the administrative law journal Neue Zeitschrift für Verwaltungsrecht (6/2016, Extra pp. 1-13), Professor Dr. Mario Martini explores the potential of and current developments in co-regulation in data protection legislation.
On the basis of the example of the GeoBusiness Code of Conduct (GeoBusiness CoC) which the SRIW (Selbstregulierung Informationswirtschaft) e.V. helped to develop and oversee, the article illustrates the potential, untapped as yet, in systematically applying the co-regulation approach.
The GeoBusiness CoC is just the second code of practice to have been officially recognised by the German supervisory data protection authorities. It creates a set of rules helping businesses to process and use state geodata in a way that complies with the legal requirements on data privacy and protection.
